The Legal Dispute Between NewJeans and ADOR: How Did It Begin?
On March 21, 2025, the Seoul Central District Court ruled in favor of ADOR in the legal dispute between K-pop girl group NewJeans and their agency.
The ruling states that NewJeans members must cease their independent activities and maintain their exclusive contract with ADOR.
However, those unfamiliar with the background of this case might wonder why a popular girl group suddenly ended up in a legal battle with their agency.
The dispute intensified in late 2024.
In November 2024, NewJeans members announced at a press conference that they were unilaterally terminating their exclusive contract with ADOR.
The members claimed that ADOR and its parent company HYBE failed to properly protect them, alleging "manipulation," "intentional misunderstandings," and workplace harassment.
In particular, they expressed dissatisfaction with the severing of their successful collaborative relationship with former ADOR CEO Min Heejin, who had been NewJeans' producer.
Subsequently, NewJeans attempted to rebrand themselves as 'NJZ' and start independent activities.
On the other hand, ADOR maintained that their contract with NewJeans members was still valid and countered that the members could not engage in any entertainment activities without the agency's consent.
The Court's Decision: Why Did NewJeans Lose?
The 50th Civil Division of the Seoul Central District Court (Presiding Judge Kim Sang-hoon) granted ADOR's injunction request for "maintaining agency status and prohibiting independent advertising contracts."
The court determined that the grounds for contract termination claimed by NewJeans members were not sufficiently proven.
The key points of the court's ruling are as follows:
- The claims and materials submitted by NewJeans members were insufficient to prove that ADOR had violated significant obligations under the exclusive contract.
- ADOR had fulfilled most of its contractual obligations, including financial compensation.
- If NewJeans were to unilaterally terminate the contract, ADOR could suffer substantial damage.
- If the group were to begin activities under a new name, it could harm both the NewJeans brand and ADOR's reputation.
In particular, the court ruled that ADOR's refusal to reinstate former CEO Min Heejin could not serve as grounds for contract termination.
The contract did not stipulate that Min Heejin must be their producer, and ADOR had the right to find a new producer.
Both Sides' Arguments: Where Does the Truth Lie?
NewJeans claimed that the phrase "the old reorgan" in HYBE's music industry report dated May 10, 2023, suggested a plan to eliminate NewJeans.
They also alleged that BELIFT LAB's girl group I'LL-IT attempted to imitate and undermine NewJeans' uniqueness.
However, considering the full context of the report, the court determined that the phrase did not contain any intention to eliminate NewJeans.
Rather, it appeared to be part of a strategy focused on the success of HYBE's other girl group, LE SSERAFIM.
The court also found insufficient evidence for the claim that I'LL-IT had imitated NewJeans.
ADOR expressed gratitude for the ruling, stating that "as NewJeans' exclusive agency status has been legally confirmed, we will fully support the artists going forward."
They added, "We look forward to having sincere conversations with the artists as soon as possible."
The Significance of the Ruling and Its Impact on the K-pop Industry
This ruling could set an important precedent for contractual relationships between idols and agencies in the K-pop industry.
Lawyer Sangrok Ko from the Korean law firm Phil explained, "In the Korean judicial system, when an agency files for an injunction to stop an artist's activities, the litigation generally proceeds in favor of the artist."
This is because courts are typically very cautious about issuing injunctions that could restrict an artist's professional freedom and cause irreparable damage.
Nevertheless, the court's decision to grant ADOR's injunction request indicates that NewJeans' claim—that the breakdown of trust was entirely caused by HYBE and ADOR—was deemed to lack a legally solid foundation.
This case demonstrates how powerful contracts between artists and agencies are in the K-pop industry, and how clear and specific evidence is required for contract termination.
Future Outlook: The Crossroads for NewJeans and ADOR
This injunction takes immediate effect, and the main lawsuit filed by ADOR is scheduled for a full hearing on April 3, 2025.
While stating that they "respect" the court's decision, NewJeans members have expressed their intention to appeal.
In an Instagram post, they stated, "As NJZ, we respect the court's decision. However, we believe this decision did not adequately consider the fact that the members' trust in ADOR has been completely destroyed."
NewJeans claimed they lost the injunction request because they weren't given enough time to fully explain their case.
They added, "Many people cannot cooperate due to pressure and fear of retaliation for being involved in the lawsuit."
Currently, NewJeans members face several options:
- Return to ADOR in accordance with the court's decision and resume activities as NewJeans.
- Continue the legal battle by proceeding with an appeal.
- Pay the penalty for contract termination and become independent.
Each option has its pros and cons.
Returning to ADOR would allow for stable activities, but it might be difficult to restore the already broken trust relationship.
Continuing the legal battle would cost time and money, and could lead to a longer hiatus from activities.
Paying the penalty and becoming independent would create a significant financial burden and uncertainties associated with a new beginning.
Fan and Public Reaction: Divided Opinions
Fans and the public have shown divided reactions to this situation.
Some support the courageous actions of NewJeans members and cheer for their independence.
They view this as raising issues about unfair contract practices and power abuse by agencies in the idol industry.
On the other hand, others criticize NewJeans' actions as disregarding contractual obligations and legal procedures.
They argue that consideration should be given to ADOR's investments and support for NewJeans' success.
On social media, while there's a movement supporting NewJeans with the hashtag "jeanzforfree," many opinions also emphasize the importance of legal procedures and contract compliance.
Contractual Relationships in the K-pop Industry: What's the Issue?
This situation raises fundamental questions about the contractual relationships between idols and agencies in the K-pop industry.
How important is the role of a specific producer or executive in an idol group's success?
Can the breakdown of a 'trust relationship' not explicitly stated in the contract be a valid reason for contract termination?
The K-pop industry is based on close collaboration between artists and agencies, but is also bound by strict contractual relationships.
This ruling has once again confirmed that legally, the clauses specified in the contract are of utmost importance.
NewJeans' Success and Current Crisis
Since their debut in 2022, NewJeans quickly rose to prominence in the K-pop market with hit songs like "Hype Boy," "Attention," and "Ditto."
They established a unique identity with their music style combining 1990s R&B and catchy pop tunes, and were even ranked as the eighth best-selling music artist worldwide in 2023.
However, the current legal dispute has brought significant uncertainty to the group's future.
In particular, this ruling has cast doubt on the group's planned independent activities, new music releases, and performances.
Conclusion: The Future Beyond Legal Disputes
The legal dispute between NewJeans and ADOR has sparked important discussions about structural issues in the K-pop industry and artist autonomy, beyond just contractual matters.
While the court's ruling reaffirmed the importance of contracts within the current legal framework, this cannot be the solution to all problems within the industry.
More evidence and arguments are expected to be presented in the upcoming main lawsuit and appeal process, which could lead to deeper discussions about contract practices and artist rights in the K-pop industry.
Most importantly, both NewJeans members and ADOR need to understand each other's positions through this conflict and establish a platform for dialogue that can move in a constructive direction.
Fans and the public love their music and performances, so they hope to see their talents on stage again rather than in legal disputes.
Historical Context of K-pop Contract Disputes
The dispute between NewJeans and ADOR is not the first of its kind in K-pop history.
In the past, several popular groups like TVXQ, EXO, and BEAST (now Highlight) have experienced contract disputes with their agencies.
These cases mostly stemmed from long-term exclusive contracts, often called "slave contracts," and unfair profit distribution issues.
However, NewJeans' case is somewhat different.
Their claims focus more on the "breakdown of trust" and the "severing of relationships with their producer" rather than contract duration or profit distribution.
This shows that the K-pop industry is evolving beyond simple business relationships into relationships based on creative partnerships and trust.
Contract Disputes from a Legal Perspective
Legal experts believe this case could set an important precedent for contractual relationships in the K-pop industry.
In particular, the legal determination of whether a "breakdown of trust" can be a valid reason for contract termination is expected to have a significant impact on similar cases in the future.
Implications from an Industry Perspective
This case has once again brought the structural issues of the K-pop industry to the surface.
While the role of producers and agencies is important for the success of idol groups, there are growing calls for artists' creativity and autonomy to be respected as well.
This suggests that the K-pop industry needs to develop a more balanced partnership model going forward.
Changes in Fandom Culture
NewJeans' fans, known as "Bunnies," are actively voicing their opinions on this matter.
Through social media campaigns supporting NewJeans and sometimes seeking legal advice, the role of fandom is evolving beyond simple support to advocating for artists' rights.
This can be seen as a case demonstrating a new aspect of K-pop fandom culture.
Future Outlook and Challenges
The dispute between NewJeans and ADOR has not yet been fully resolved.
With the appeal process and main lawsuit still pending, the case is expected to continue drawing significant attention.
It will be interesting to see how both sides find a compromise and how this will shape the direction of the K-pop industry's development.
Most importantly, this situation should serve as an opportunity to create a new model where artists' rights and creativity can harmoniously coexist with agencies' investments and expertise.
This will be an essential process for K-pop to advance to a more mature position in the global music industry, beyond simply being a legal issue.
Ultimately, the dispute between NewJeans and ADOR could serve as an important turning point for reflecting on the current state of the K-pop industry and preparing for its future.
This should be taken as an opportunity for artists, agencies, fans, and the industry as a whole to grow and develop together.
The future of K-pop can become even brighter through such challenges and innovations.
